ENFORCEMENT OFFICER- 10 POSITIONS

About the organization
Our client, the Anti-Counterfeit Agency (ACA) is a specialized government agency established under the Anti-Counterfeit Act, No.13 of 2008. Its mandate is to educate and inform the public on matters relating to counterfeiting and to combat counterfeiting, trade and other dealings in counterfeit goods, through co-ordination with national, regional and international organizations involved in combating counterfeiting.

The Agency is now seeking dynamic self-starters, with exceptional communication and IT skills, who will work flexibly in a small but highly professional team, respond imaginatively to a varied and demanding range of tasks and have the ability to turn strategy into practical measures while mastering complexity and detail.

Reporting to an Assistant Director, Enforcement and Prosecutions the Enforcement Officer will undergo an induction and training program of up to 3 months prior to being posted to the field as an Inspector or Prosecutor under the Anti-Counterfeit Act, or as an Analyst in the enforcement back-office function. They will ensure that enforcement, investigation and prosecution policies, strategies and procedures are in place and duly observed at all times. Analysts will be called upon to collect, compile and analyze information received from various sources to support robust enforcement activities.

Additional responsibilities include:
Drafting of charge sheets and filing cases ¡n courts;
Entering goods into the inventory and transferring them into the counterfeit goods depot and ensuring safe custody of exhibits;
Investigating complaints from intellectual property rights owners;
Ensuring that witnesses attend court through witness summons;
Assisting in conducting prosecution of cases and taking part ¡n compiling court files/cases;
Conducting raids on premises suspected to contain counterfeit goods;
Carrying out follow ups on cases of complaints on counterfeit goods;
Sampling goods for testing and analysis and compiling reports on suspected counterfeit goods; and
Managing information from various sources, collating and analyzing the same to produce actionable product to inform enforcement activities.
Requirements
  • Applicants must have utmost integrity and a strong sense of mission and purpose to serve the public.
  • They should hold an honors Bachelor’s degree in Law, Commerce, Social Sciences, Physical Sciences or equivalent degree from a recognized university and a certificate in a relevant professional course.
  • They must demonstrate above average analytical, wring and presentation skills.
  • The candidates should have a minimum of two (2) years’ experience in a structured and formal work environment; experience in research, investigations, forensic auditing and accounting as well as languages will be an added advantage.

  • For the management positions candidates are required to have management competencies that will enable them to participate in the development of strategic plans, annual work-plans and budgets as well as exercise supervisory oversight over teams in order to improve performance standards and organizational effectiveness.
  • For all the positions, it is important that applicants are Kenyan citizens and persons of integrity with demonstrable high ethical standards which meet the requirements of Chapter Six of the Constitution of Kenya.
  • They must be computer literate with excellent knowledge of relevant computer software and applications as well as strong end user skills and proficiency in MS Office programs.
