About the organization
Our client, the
Anti-Counterfeit Agency (ACA) is a specialized government agency established
under the Anti-Counterfeit Act, No.13 of 2008. Its mandate is to educate and
inform the public on matters relating to counterfeiting and to combat
counterfeiting, trade and other dealings in counterfeit goods, through
co-ordination with national, regional and international organizations involved
in combating counterfeiting.
The Agency is now
seeking dynamic self-starters, with exceptional communication and IT skills,
who will work flexibly in a small but highly professional team, respond
imaginatively to a varied and demanding range of tasks and have the ability to
turn strategy into practical measures while mastering complexity and detail.
Reporting to the Chief
Legal Officer, Enforcement, Prosecutions and Legal Services, the jobholder will
draft contracts and other legal documents, render opinions, evaluate and
perform legal audits of documents received by the organization; and under the
direction of the Chief Legal Officer, undertake civil and criminal prosecutions
as well as represent the organization in judicial and other dispute resolution
proceedings.
Additional responsibilities include:
- Implementation of the provisions of the legislation administered by the Agency;
- Compile cases and update legal data-base to record information on successfully completed prosecutions or other enforcement actions;
- Prepare legal drafts and negotiate contracts, leases, formal agreements and other legal instruments between the Agency and other parties, participate ¡n settlement and arbitration of disputes to ensure compliance with Anti-Counterfeit Act and related statutory requirements;
- Conduct legal research, develop concept papers, prepare legal briefs and opinions as well as develop effective defence strategies, arguments and testimony ¡n preparation for legal proceedings;
- Attend court on behalf of the Agency and prosecute criminal matters ¡n both subordinate and superior courts of record.
Requirements
- Applicants should hold a Bachelor’s degree in Law (LLB), a Postgraduate diploma in Law from the Kenya School of
- Law, Admission to the Roll of Advocates and a current Practising Certificate.
- A Master’s degree in a relevant field will be an added advantage.
- A minimum of three years post admission experience is required.
Additional Requirements
- For the management positions candidates are required to have management competencies that will enable them to participate in the development of strategic plans, annual work-plans and budgets as well as exercise supervisory oversight over teams in order to improve performance standards and organizational effectiveness.
- For all the positions, it is important that applicants are Kenyan citizens and persons of integrity with demonstrable high ethical standards which meet the requirements of Chapter Six of the Constitution of Kenya.
- They must be computer literate with excellent knowledge of relevant computer software and applications as well as strong end user skills and proficiency in MS Office programs.
