About the organization
Our client, the
Anti-Counterfeit Agency (ACA) is a specialized government agency established
under the Anti-Counterfeit Act, No.13 of 2008. Its mandate is to educate and
inform the public on matters relating to counterfeiting and to combat
counterfeiting, trade and other dealings in counterfeit goods, through
co-ordination with national, regional and international organizations involved
in combating counterfeiting.
The Agency is now
seeking dynamic self-starters, with exceptional communication and IT skills,
who will work flexibly in a small but highly professional team, respond
imaginatively to a varied and demanding range of tasks and have the ability to
turn strategy into practical measures while mastering complexity and detail.
Reporting to the Deputy
Director, Enforcement, Prosecutions and Legal Services the successful candidate
will oversee the enforcement and implementation of the legislation administered
by the Agency, advice and represent the Agency in legal proceedings. They may
also be called to deputize for the Board Secretary when called upon to do so.
Key responsibilities include:
- Coordinating the implementation of the provisions of all legislation administered by the Agency;
- Advising and representing the Agency in legal proceedings;
- Take minutes during board and management meetings when requested;
- Compile weekly, monthly, quarterly and annual reports on all cases being handled by the Agency;
- Negotiate Out-Of-Court settlements between parties where necessary;
- Maintain a register on loans and debts by the Agency and staff;
- Develop and implement training programmes for legal officers;
- Prepare opinions, briefs, papers and memoranda and maintain a prosecutions register; and
- Represent the Agency in court or attend court on behalf of the Agency and prosecute criminal matters in both subordinate and superior courts of record;
Requirements
- The ideal candidate will hold a Bachelors degree in Law (LLB) from a recognized university; a Postgraduate diploma in Law from the Kenya School of Law and Admission to the Roll of Advocates.
- A Masters degree in Commercial Law, Business Administration, Economics, Finance or a related field will be a distinct advantage.
- They should be a qualified CPS(K) and an Advocate of the High Court of Kenya with a minimum of five (5) years post-admission experience in providing legal services, of which at least three (3) years were as a Senior Legal Officer/ Prosecution Counsel or in a comparable position.
Additional Requirements
For the management
positions candidates are required to have management competencies that will
enable them to participate in the development of strategic plans, annual
work-plans and budgets as well as exercise supervisory oversight over teams in
order to improve performance standards and organizational effectiveness.
For all the positions,
it is important that applicants are Kenyan citizens and persons of integrity
with demonstrable high ethical standards which meet the requirements of Chapter
Six of the Constitution of Kenya.
They must be computer
literate with excellent knowledge of relevant computer software and
applications as well as strong end user skills and proficiency in MS Office
programs.
